Employers will be facing important decisions about the COVID vaccination as it becomes available that need to be considered ahead of time. Some of these issues include can it be mandatory, whether it should be mandatory, what kinds of exceptions will need to be made if it is mandatory, what legal exposure might result from a mandatory requirement to have it, and what the alternatives are to making it mandatory. Many laws are going to come into play here, including the ADA, Title VII, GINA, possibility the FMLA, and workers’ compensation.
